Introduction

These General Terms and Conditions (“Terms”) govern the use of the platform operated by Guido Mobility Services AG, with address Dersbachstrasse 61, 6333 Hünenberg See, Switzerland.

By using the Platform, both vehicle owners and garages (“Users”) agree to these Terms. If you do not agree to these Terms, please refrain from using the Platform.

Services

The Platform provides a digital interface for fleet managers to schedule and plan the repair and maintenance of vehicles, facilitating transparency in the quotation and approval process.

Garages make offers for repair and maintenance services to vehicle owners through the Platform. Once an offer is accepted, the garage will order the necessary parts and perform the services.

Guido Mobility Services AG acts as an intermediary for payment processing. Garages invoice Guido Mobility Services AG for labor and parts, and Guido Mobility Services AG subsequently invoices the vehicle owners.

Guido Mobility Services AG is not responsible for the actual repair and maintenance services provided by the garages.

Registration and Account

Users must register to access and use the Platform.

Users are responsible for maintaining the confidentiality of their account information and are liable for all activities under their account.

Data Protection

All personal data provided by Users will be handled in accordance with our Data Protection Policy. By using the Platform, Users consent to the collection, processing, and storage of their personal data as outlined in the Data Protection Policy.

Users can access and review the Data Protection Policy to understand how Guido Mobility Services AG collects, uses, and protects their personal data.

Intellectual Property and Copyrights

All content, designs, graphics, logos, software, and other intellectual property on the Platform are the property of Guido Mobility Services AG or its licensors and are protected by Swiss and international copyright laws.

Users are granted a limited, non-exclusive, non-transferable license to access and use the Platform and its content for personal, non-commercial purposes. Any other use, reproduction, modification, distribution, or storage of any content from the Platform without the express written permission of Guido Mobility Services AG is strictly prohibited.

Users must not remove, alter, or obscure any copyright, trademark, or other proprietary rights notices appearing on the Platform.

Unauthorized use of the Platform’s content may result in legal action for infringement of intellectual property rights.

Obligations of Garages

Garages are required to provide accurate quotations for services.

Garages must ensure that all services are performed to a high standard, in compliance with Swiss regulations and industry standards.

Garages are responsible for ordering and procuring the necessary parts once an offer is accepted.

Obligations of Vehicle Owners

Vehicle owners must provide accurate information about their vehicles to receive appropriate quotations.

Vehicle owners are responsible for approving or rejecting quotations in a timely manner.

Payments

Garages will invoice Guido Mobility Services AG for the services rendered and parts provided.

For the interventions performed via its platform, Guido Mobility Services AG will invoice vehicle owners.

All invoices issued through the Platform are due for payment within 30 days from the date of the invoice. Failure to make payment within this period may result in additional charges, suspension of services, or other remedies as deemed appropriate by Guido Mobility Services AG.

Warranty and Guarantee

Garage Service Guarantee: The garage guarantees the quality of the installation and services provided. Should any issues arise due to the installation or the service rendered, the garage commits to rectifying the issue in accordance with the terms set out herein.

Parts Warranty: In the event of a defective part, the warranty agreement between the parts supplier and the garage will apply. It is the responsibility of the fleet owner to report any defects or issues with the parts to the garage directly.

Labor Warranty: In cases where a defective part needs to be de-installed and replaced, the garage will bear the labor costs for both the de-installation of the defective part and the installation of the new one. This labor warranty is offered exclusively by the garage and is intended to ensure the satisfaction of the fleet owner without incurring additional labor charges.

Liability

Guido Mobility Services AG is not liable for any damages or losses resulting from the use of the Platform, except as required by Swiss law.

Users are responsible for resolving disputes among themselves.

Termination

Guido Mobility Services AG reserves the right to terminate a User’s account for violations of these Terms or any applicable Swiss laws.

Governing Law

These Terms are governed by and construed in accordance with Swiss law. Any disputes arising from these Terms will be resolved in the competent courts of Switzerland.

The parties agree that this contract shall be governed, construed and enforced in accordance with applicable Swiss law, excluding the laws regulating the international purchase of movable goods (especially the UN-Convention on Contracts of the International Sale of Goods) and its rules on the conflict of law.  Place of jurisdiction is the Canton of Zug.

Amendments

Guido Mobility Services AG may update these Terms from time to time. Users will be notified of any significant changes.
