§ 1Definitions
For the purposes of these GTC, the following definitions apply:
- User
- the adult natural person who registers on the platform and books a service for non-professional use.
- Garage
- the independent third-party service provider, selected and contractually bound by Guido, who carries out the work on the User's vehicle.
- Service job
- any technical service performed by the Garage on the User's vehicle (maintenance, repair, inspection, tyre change, etc.).
- Booking
- the agreement concluded via the platform between the User and the Garage, with Guido acting as technical and accounting intermediary.
- Platform
- the guido-mobility.ch website, the mobile application and the related services operated by Guido Mobility Services AG.
§ 2Scope of the service
Guido acts as a digital intermediary between private Users and independent Garages. Guido provides a platform for searching, booking, paying for and documenting work on the User's vehicle.
Guido does not carry out work itself and assumes no responsibility for the technical quality of the service performed by the Garage, which is governed exclusively by the contract for work concluded between the User and the Garage.
Guido does, however, guarantee: (i) the prior vetting of every Garage according to published criteria; (ii) the setting of fixed prices or a transparent price-formation mechanism; (iii) insurance cover for damage to the vehicle while in the Garage's custody; (iv) a dedicated complaints channel.
§ 3Conclusion of the Booking
The Booking is finalised upon the electronic confirmation sent by Guido to the User's email address, containing the vehicle details, the chosen service, the Garage, date and time, and the final price.
Before confirmation, the User: (a) registers a valid payment card on the platform; (b) expressly accepts these GTC and the privacy policy; (c) declares the accuracy of the vehicle data provided (plate, mileage, any known issues).
- Bookings are personal and may not be transferred to third parties without Guido's written consent.
- Any additional services that become necessary during the work require the User's explicit authorisation before execution and result in a separate charge.
- Guido may refuse a Booking, with reasons, if the Garage is unable to provide the service or if the vehicle requires expertise outside the partner network.
§ 4Changes and cancellation
The User may change or cancel the Booking free of charge up to 24 hours before the scheduled time, via their booking dashboard.
In the event of cancellation or no-show within 24 hours before the appointment, a flat fee of CHF 30.00 is due, charged to the registered card. The fee is intended to cover the cost incurred by the Garage.
This fee does not apply in cases of documented force majeure (illness, accident, exceptional weather events) reported in good time to Guido support.
§ 5Prices and payment terms
The prices shown on the platform include labour, standard consumables and VAT (8.1%). Any specific parts are included if so indicated on the booking sheet. Ancillary services (e.g. a paid replacement car) are shown separately.
The User's card is charged only upon confirmed completion of the work, typically within 60 minutes of vehicle pick-up. A pre-authorisation of the nominal value may be made at the time of Booking solely to verify the validity of the payment method.
Card data neither passes through nor is stored on Guido's systems; it is held by the payment processor Stripe Payments Europe Ltd., which is PCI-DSS Level 1 compliant.
§ 6Warranty and complaints
Every job is covered by 12 (twelve) months' warranty on the labour, starting from the date the work is completed. The warranty on parts is that of the manufacturer (usually 24 months).
In the event of a defect covered by the warranty, the User notifies Guido within 14 days of discovery. Guido coordinates the free rework with the Garage.
By definition, a defect is any deviation from the agreed result of the work, attributable to workmanship not carried out to a professional standard or to the use of non-conforming materials.
§ 7Limitation of liability
Guido's liability for direct damage arising from the use of the platform is limited to twice the price of the Booking in question. Liability for indirect damage, loss of profit or loss of opportunity is excluded.
The limitation does not apply in cases of wilful intent or gross negligence, personal injury, or where the applicable law prohibits it.
§ 8Data protection
The processing of personal data is governed by the privacy policy available at guido-mobility.ch/it/privacy/, which forms an integral part of these GTC.
§ 9Applicable law and jurisdiction
The relationship between Guido and the User is governed by Swiss law, excluding international conflict-of-law rules and the Vienna Convention on the International Sale of Goods.
The exclusive place of jurisdiction is Zurich, subject to mandatory provisions in favour of the consumer. The consumer User's right to bring proceedings at their place of domicile in Switzerland remains reserved.
§ 10Changes to the GTC
Guido may amend these GTC with a minimum of 30 days' notice, communicated by email to all registered Users. Use of the platform after the effective date constitutes acceptance of the new GTC.
